This Bill is a clear violation of the U.S. Constitutional guarantee of Separation of Church & State. "5239. RULEMAKING The Commissioner of Health may adopt rules pursuant to 3 V.S.A. chapter 25 as needed to carry out the provisions of this chapter." It is completely UN-constitutional for any Commissioner of Health to make any rules or regulations that can deprive you or your loved ones of your body parts. Clearly this proposed new law is a violation of the United States Constitution and your right to your own private property which includes your body, even after death. This proposed new law which deprives you of "informed consent" and replaces that with "presumed consent" is entirely Un-American and REPULSIVE. The legislative legal counsel should be dis-barred for conspiracy to violate your rights under the United States Constitution.

And what I've been hearing is changing my thinking on this issue. First, let me make clear that the proposed bill would not put the state in charge of organ donation. The intent was to make it easier for the dying and/or survivors to deal with the topic of whether to donate or not. I remember getting a phone call around 2:00 AM the night my father died asking me to approve donation of his organs. I did not react well to it. In the midst of my grief it felt to me as if the vultures had been circling, just waiting for him to
  • 8. die. The proposed bill hopes to remove that issue. My father was very much in my mind when I agreed to co-sponsor the bill. On the other hand, the presumed consent piece also makes me uncomfortable. I agree that many people, especially if the death is sudden and unexpected, would not know about the opt out issue. Although I hope the hospital or attending health personnel would be open and forthright about it and deal fairly with the survivors, there is no guarantee that they will. That is now feeling a bit too "iffy" for me now. This issue illustrates why it's important that voters communicate with their representatives. The feedback I've been getting on this issue forced me to look at it from a different angle and discovering what I originally thought was a good idea has serious flaws. Rep. Tommy Walz
